Question : I wanted to follow up with you and find out if you are looking for one complete vendor for all of the goods listed and requested or if it would be possible to bid on part of the items. I am wondering if we are able to bid on the items we immediately have available and the item that at this moment we do not have access we could possibly bid on later if and when it becomes available. 
Answer : The awarded vendors must be able to provide all items and services per group (Nortel or Avaya). Vendors do not have to bid both groups.

Subject : Specifications Questions 
Question : Section 1.5 of the Specifications document states that this bid may be used to purchase additional telephone systems and components. The bid does not contain the necessary terms to give this Vendor the ability to sell products or license software. Necessary terms are title transfer, risk of loss, software license right to use, intellectual property rights, infringement defense and indemnification, limitations of liability, and customer acceptance. Will MDCPS allow the Vendor to include the required terms at point of sale? Additionally, what vehicle will MDCPS use to apply post warranty maintenance services to any purchased system?  
Answer : Yes, vendors may give the necessary terms at time of purchase of equipment. However, if the terms are not agreeable M-DCPS would proceed to its other vendors on the bid. How post warranty maintenance will be purchased will be dependent on the equipment for which the maintenance will be purchased.

Subject : Special Conditions 
Question : We would like to know if the "Special Conditions" is available in WORD format so we can reply to each section?  
Answer : The Special Conditions are available in WORD format, however we will not send this file out since there is no need to respond to each section. The bid Special Conditions are posted in order to be signed AS IS. M-DCPS will not accept additional terms and conditions or any changes to the bid Special Conditions; therefore your company will need to sign the bid documents as is with no additional documentation besides the information requested for bid submittal. If additional terms and conditions are submitted your bid will not be considered for award.
